1. Acceptance of Terms

By accessing or using the CastleFX website at castlefx.com (the “Site”) or any services provided by Castle Currency Management, Inc. (“CCM,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree with any part of these Terms, you must not use the Site or our services.

These Terms constitute a legally binding agreement between you and Castle Currency Management, Inc. CCM operates the CastleFX brand and platform and is incorporated in the State of Texas. Castle Currency Exchange Inc. (“CCFX”) is a separate legal entity under common ownership that operates independently in Canada and is not a party to these Terms. Your continued use of the Site constitutes your ongoing acceptance of these Terms as they may be updated from time to time.

2. Description of Services

CCM provides currency strategy services, consulting, educational content, currency risk management resources, customer support, and related business services through the CastleFX platform. CCM also facilitates access to and supports currency exchange and global payment transaction services on behalf of its clients. Our services include, but are not limited to:

Currency exchange and international payment transaction services, facilitated through regulated third-party service providers
Currency strategy subscription services (daily and weekly market guidance)
Rate alert subscriptions
Expert currency consulting sessions
Educational workshops, webinars, and resource materials
Live currency market charts and data tools

All currency exchange and payment transaction services are executed by regulated third-party service providers. CCM manages client relationships, provides strategy guidance, and supports clients through the transaction process. Trade execution, fund movement, and regulatory compliance obligations for transactions are the responsibility of the applicable regulated service provider.

3. Eligibility

To use the Site or open an account with CastleFX, you must:

Be at least 18 years of age
Have the legal authority to enter into binding agreements on behalf of your organization
Be a business entity operating lawfully in your jurisdiction
Not be located in, or a national of, any jurisdiction subject to applicable US, Canadian, or international sanctions

CCM reserves the right to refuse service to any person or entity at our sole discretion, including to ensure compliance with applicable anti-money laundering and know-your-customer requirements.

4. Account Registration

To access certain services, you must register for an account. By registering, you agree to:

Provide accurate, current, and complete information as required during the registration process
Maintain the security of your account credentials and notify us immediately of any unauthorized access
Accept responsibility for all activities that occur under your account
Not share your account credentials with any third party

CCM and its regulated service providers are required to verify the identity of account holders and may request documentation to satisfy know-your-customer (KYC) and anti-money laundering (AML) obligations. Accounts may be suspended or closed if required information is not provided or if there is reason to believe that the account is being used for unlawful purposes.

5. Acceptable Use

You agree to use the Site and our services only for lawful purposes and in accordance with these Terms. You must not use the Site or services to:

Engage in, facilitate, or conceal money laundering, terrorist financing, fraud, or any other illegal activity
Violate any applicable local, provincial, national, or international law or regulation
Transmit any material that is defamatory, offensive, or otherwise objectionable
Attempt to gain unauthorized access to any part of the Site or any related systems
Introduce malicious code, viruses, or disruptive software to the Site
Collect or harvest any personal information about other users
Use automated tools to scrape, crawl, or extract content from the Site without our express written permission
Impersonate any person or entity, including CastleFX employees or representatives

6. Currency Exchange Services

All currency exchange and international payment transactions facilitated through CastleFX are subject to the terms of our Client Agreement, which you will receive upon account opening. In addition:

Exchange rates quoted are indicative until confirmed in writing. Final rates are locked at the time of transaction confirmation.
Transactions are subject to availability of funds, compliance review, and applicable regulatory requirements.
CastleFX reserves the right to cancel or refuse any transaction where we have reason to believe it may violate applicable laws or regulations, or where required to do so by a regulatory authority.
International transfers are subject to the laws and regulations of both the sending and receiving countries, which may affect timing and availability of funds.
Currency exchange involves inherent risk. The value of currencies fluctuates and past rates do not guarantee future rates.

7. Subscriptions and Payments

Certain services, including Currency Strategy subscriptions and Rate Alert subscriptions, are offered on a recurring subscription basis. By subscribing:

You authorize CastleFX and our payment processor (Stripe) to charge your payment method on a recurring monthly basis at the applicable subscription rate.
Subscriptions renew automatically unless cancelled before the next billing date.
You may cancel your subscription at any time through the subscription management portal. Cancellation takes effect at the end of the current billing period.
Subscription fees are non-refundable except where required by applicable law.
CastleFX reserves the right to modify subscription pricing with reasonable notice to subscribers.

Workshop and webinar registration fees, consulting session fees, and other one-time payments are processed securely through Stripe. Payment terms specific to each product or service will be presented at the time of purchase.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Castle Currency Management, Inc. or its content suppliers and is protected by applicable intellectual property laws.

You may view and print pages from the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Site without our express written permission.

The CastleFX name, logo, and all related trademarks and service marks are the exclusive property of Castle Currency Management, Inc. Nothing on the Site grants any license to use these marks without our prior written consent.

9. Disclaimers

The Site and all content are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Currency strategy content, including all daily and weekly strategy subscriptions, rate alerts, webinars, workshops, and market commentary, reflects CCM’s independent analysis and professional judgment based on technical and market conditions at the time of publication. This content is designed to help businesses with operational currency exposure reduce the time and resources required to monitor currency markets and make informed hedging and transaction timing decisions. It does not constitute regulated investment advice or a solicitation to transact, and is not intended for use by individuals or for speculative trading purposes. Currency markets involve inherent risk and past strategy performance does not guarantee future results. Clients are responsible for their own transaction decisions. CCM does not execute transactions on behalf of clients.

CastleFX does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any market data, rates, or other information displayed on the Site.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Castle Currency Management, Inc. and its directors, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or our services, including but not limited to loss of profits, loss of data, or currency exchange losses, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or in connection with these Terms or your use of the Site shall not exceed the greater of: (a) the total fees paid directly by you to Castle Currency Management, Inc. in the three months preceding the claim, or (b) USD $500.

Some jurisdictions do not allow the exclusion or limitation of certain types of liability, so the above limitations may not apply to you in full.

11. Indemnification

You agree to indemnify, defend, and hold harmless Castle Currency Management, Inc. and its directors, officers, and employees from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Site or services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas. If you are using our services from outside the United States, you are responsible for compliance with local laws to the extent they are applicable.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
